Trade secret is any technical know how or business information that:
-is secret, i.e. not in the public domain
-has commercial value because it is secret
-has been subject to reasonable steps to keep it a secret.
(This definition has been confirmed in the EU Trade Secret Directive ( 2016/943/EU) of 5 July 2016, implemented across EU Member States in 2018).
A trade secret can exist for a very long period. If made public, it is no longer enforceable unless the owner has timely filed a patent (enforceable for 20 years) or, unless the publication is a result from misappropriation.
