What is a Trademark?

A trade mark is a sign that can be represented graphically to identify and distinguish the origin and quality of goods and services in a specific domain or territory. It is a unique symbol consisting of any graphically representable signs and symbols that identify and distinguish your product and services from those of your competitors. Your trademark may consist of:

  • a word (or different words),
  • a design (logo),
  • or a combination of those as long as it is distinctive and not descriptive.

You can also register

  • a three-dimensional shape,
  • a combination of colours,
  • or even a sound.

Your trademark may also consist of other distinguishable symbols, such as your company or trade name or even your domain name.

The sign/symbol has to be distinctive and not descriptive of the goods and services to be used under the mark.

An individual trademark is used by a single entity, normally to distinguish and promote their goods and services.

A collective trademark serves to distinguish one or more characteristics of the goods and services of a group of several different companies, all authorized by the owner of the trademark to use the mark according to Specific Use Regulations.
