Pre-filing Searches

In a first-to-use jurisdiction an Internet search – even if not complete – might be a good indication of potential threats before adopting a mark. However, Europe has a first-to-file system, and although a mark might not be found via an Internet search, it might still be registered and thus become a real obstacle to a new trademark.
