Legal Conditions

A patent will be granted for an invention that meets the patentability requirements, being:

    The invention is not known as a whole
  • Inventive step:
    The invention is not derivable by a simple combination of known features
  • Industrial applicability:
    The invention should contribute to the industrial evolution.

These requirements shall be considered in relation to the state of the art, which is held to comprise:

  • Everything made available to the public:
    This includes all territories and languages, but excludes confidential disclosures
  • By means of written or oral description, by use or in any other way:
    This includes showing an example of the invention to just one person
  • Before the date of filing of the patent:
    This includes disclosures by the inventor and/or patentee before the filing date.
